Representative Jasmine Crockett was sitting in a House Oversight Committee hearing last fall, growing increasingly frustrated as she listened to Republicans accuse President Biden of impeachable offenses without producing any evidence, when she had an idea. Ms. Crockett, a freshman Democrat from Texas and former defense attorney, summoned an aide and asked them to quickly print out a stack of photos showing the boxes of sensitive government documents stashed by a toilet at Mar-a-Lago, former President Donald J. Trump’s club in Palm Beach, Fla. Moments later, Ms. Crockett was brandishing the photos above her head, accusing Republicans of ignoring clear evidence that Mr. Trump had violated the law while pushing allegations against Mr. Biden for which they had shown no proof. “When we start talking about things that look like evidence, they want to act like they blind,” Ms. Crockett said of Republicans, spitting her words with a mix of outrage and bemusement. “These are our national secrets,” apparently in a toilet, she added, using an expletive to describe the plumbing.

CNN —The Department of Justice doubled down on its decision to not release the audio files of President Joe Biden’s interview with special counsel Robert Hur to House Republicans, stating that Republicans have not established a legitimate legislative purpose for demanding these recordings, in a new letter obtained by CNN. The DOJ’s refusal to turn over the audio comes as Republicans find their impeachment inquiry into the president stalled now that the prospects of the investigation ending in impeachment are increasingly unlikely. Without the votes in their narrow majority or evidence of an impeachable offense, Republicans are now struggling with how to end their probe. Uriarte pointed to the possibility that audio files can be manipulated through “cutting, erasing, and splicing” in a way that increases the privacy concerns of the witness. Uriarte therefore accused Republicans of going after these audio files for the wrong reasons.

On Wednesday, Senate Democrats voted to declare as unconstitutional both articles of impeachment against Department of Homeland Security Secretary Alejandro Mayorkas — effectively ending the trial. It put a swift end to what had been a monthslong process by House Republicans, championed originally by Rep. Marjorie Taylor Greene of Georgia. Democrats agreed with Schumer's move, effectively rendering the articles moot and the trial over before House Republicans could present their case. WASHINGTON (AP) — The House of Representatives is expected to vote Tuesday on whether to impeach Homeland Security Secretary Alejandro Mayorkas. The vote will be the culmination of months of examination by House Republicans as they've aimed to make immigration and border security a key election issue. Republicans have laid the blame for all of this on the Homeland Security secretary and said that because of it, he needs to go. The House Homeland Security Committee has been holding hearings over roughly the last year where Republicans have repeatedly lambasted Mayorkas. That's the body that would decide whether to convict the secretary or not and if he's convicted then Mayorkas is no longer Homeland Security secretary.

CNN —A plague on both these houses:The Senate seems to lack the political will for a bipartisan border deal. The House lacks an effective majority for a partisan impeachment effort as GOP leaders scramble for votes. Except, as the vote approached, they seemed to realize they might not have the votes to impeach Mayorkas after all. The only other time a Cabinet member was impeached, back in 1876, it was with a unanimous House vote. Opening a half-baked, highly partisan investigation into President Biden was a cheap stunt. But I’d argue that as House Republicans move forward with a floor vote to impeach Alejandro Mayorkas, the homeland security secretary, they are poised to drag the chamber down an even more tortured — and potentially damaging — path. Yes, the Biden impeachment folly is built on a steaming pile of unsubstantiated charges and fever dreams sprung from the House’s conspiracy caucus.
